These Terms govern your use of Swixli, operated by Swixli LLC. By creating an account or using the app, you agree to them.
Swixli is a peer-to-peer marketplace platform that connects local buyers and sellers. We are not a party to any transaction between users. We do not buy, sell, inspect, authenticate, or guarantee any item listed on the platform. All transactions are arranged and completed directly between users.
You must be at least 18 years old to create an account and use Swixli. By registering, you confirm that you are 18 or older and that the information you provide is accurate and complete. If you are under 18, you may not use the platform.
You may not list, offer, or sell: firearms, ammunition, or weapons of any kind; illegal drugs, controlled substances, or drug paraphernalia; stolen, counterfeit, or fraudulently obtained goods; live animals or wildlife products; adult content, sexually explicit material, or escort services; alcohol or tobacco products; prescription medications; hazardous materials; or any item whose sale is prohibited by applicable federal, state, or local law. Violations will result in immediate listing removal and account termination.
You agree not to: impersonate another person or create a false identity; engage in fraud, scams, phishing, or deceptive practices of any kind; use the platform to launder money or facilitate any financial crime; harass, threaten, or abuse other users; post false, misleading, or inaccurate listings; circumvent or attempt to circumvent any safety or moderation system; scrape, copy, or harvest data from the platform; or use Swixli for any commercial spam or unsolicited advertising. Violations may result in immediate account suspension or permanent ban and may be reported to law enforcement.
All content you post — including listing photos, descriptions, and messages — must be accurate and lawful. You may not post content that is sexually explicit, pornographic, or exploitative; that depicts or promotes violence, hate speech, or discrimination based on race, religion, gender, sexual orientation, national origin, or disability; that infringes on any third party's intellectual property rights; or that violates any applicable law or regulation. Swixli uses automated and manual review to enforce these standards and may remove content or suspend accounts at its sole discretion.
You are solely responsible for your own safety when meeting another user. Swixli strongly recommends meeting only in well-lit, public places; bringing a friend or family member; telling someone where you are going; and trusting your instincts. Never meet in a private location with someone you do not know. Swixli is not responsible for any physical harm, theft, or other incident that occurs during a meetup.
Verification badges indicate a user has completed our verification steps, but Swixli does not guarantee the true identity, age, or intentions of any user. You are responsible for exercising your own judgment before meeting or transacting with another user.
You are solely responsible for determining and fulfilling any tax obligations that arise from your use of Swixli, including income taxes, sales taxes, and self-employment taxes. Swixli does not process payments, does not withhold taxes on your behalf, and does not issue tax forms (such as 1099-K) to users. If you have questions about your tax obligations, consult a qualified tax professional.
Swixli is not responsible for the quality, safety, legality, or accuracy of any listing. We are not liable for any loss, injury, damage, or harm — including theft, fraud, physical harm, or financial loss — arising from any transaction or meetup arranged through the app. Your use of the platform and all transactions you enter into are conducted entirely at your own risk.
Swixli and its logos, designs, and content are the intellectual property of Swixli LLC. By posting content on the platform, you grant Swixli a non-exclusive, royalty-free license to display and distribute that content solely to operate the service. You represent that you own or have the right to use all content you post. If you believe content on Swixli infringes your copyright, contact us at support@swixli.com.
Swixli may suspend or permanently ban your account at any time for violations of these Terms, fraudulent activity, abusive behavior, or any conduct we determine to be harmful to users or the platform. Repeated violations or serious offenses (including fraud or illegal activity) may be reported to law enforcement. You may delete your account at any time from your profile settings.
You agree to indemnify and hold harmless Swixli LLC and its officers, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the platform, your listings or transactions, your violation of these Terms, or your violation of any third-party rights.
To the maximum extent permitted by law, Swixli LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of the platform. Our total liability for any claim related to the platform shall not exceed $100.
Any dispute arising from these Terms or your use of Swixli shall be resolved by binding arbitration under the rules of the American Arbitration Association, on an individual basis. You waive any right to bring or participate in a class action lawsuit or class-wide arbitration. This agreement is governed by the laws of the State of New Jersey.
Swixli reserves the right to update these Terms at any time. Continued use of the app after changes are posted constitutes your acceptance of the updated Terms. For questions, contact support@swixli.com.
